In letzter Zeit häufen sich Meldungen über sog. Identitätsdiebstahl: Dritte betreiben gefälschte Websites, die den Websites von seriösen, von der FINMA bewilligten Finanzinstituten ähneln. Häufig nutzen sie Domains mit identischen oder sehr ähnlichen Namen echter Finanzinstitute, um das Vertrauen von Anlegerinnen und Anlegern zu gewinnen und scheinbar attraktive Festgeld- oder Anlageangebote zu unterbreiten. Laut eigenen Angaben haben betroffene Anlegerinnen und Anleger bereits finanzielle Verluste erlitten.
Die Vermeidung von Internetpräsenz ist hierbei möglicherweise kontraproduktiv, da Institute ohne eigene Webpräsenz besonders gefährdet zu sein scheinen. Instituten ohne Webpräsenz wird daher empfohlen, regelmässig mittels Suchmaschine zu prüfen, ob ein Internetauftritt mit dem eigenen oder einem ähnlichen Namen auffindbar ist. Es gilt abzuwägen, ob eine eigene Website eingerichtet und vor allem relevante Domains gesichert werden sollen.
Wird ein Finanzinstitut Opfer eines solchen Identitätsdiebstahls, sollten mögliche Schritte erwogen werden wie z. B. Blockierung der Fake-Website und/oder Warnhinweis auf der eigenen Website (sofern das Finanzinstitut eine Website hat), Strafanzeige oder rechtliche Beratung. Auch eine direkte schriftliche Information an alle Kunden mag ratsam sein– mit dem Hinweis, dass sich Dritte als Finanzinstitut ausgeben und vor allfälligen Investments oder Überweisungen eine Rücksprache mit den vertrauten Kontaktpersonen des Finanzinstituts sinnvoll erscheint.
Die FINMA kann auf Antrag des Finanzinstituts eine Warnmeldung veröffentlichen (https://www.finma.ch/de/finma-public/warnungen/). Da dies jedoch auch zu negativer Publizität führen kann, sollte eine solche Maßnahme gut überlegt sein.

There have been increasing reports of so-called identity theft recently: third parties are operating fake websites that resemble the websites of reputable financial institutions authorized by FINMA. They often use domains with identical or very similar names of real financial institutions to gain the trust of investors and offer seemingly attractive fixed-term deposits or investment opportunities. According to their own statements, affected investors have already suffered financial losses.
Avoiding an online presence could be counterproductive in this context because financial institutions without own website particularly seem to be at risk. Institutions without a website are therefore advised to regularly use a search engine to check whether a website with their own name or a similar name can be found. It is important to weigh the pros and cons, if a website should be set up and relevant domains secured.
If a financial institution falls victim to such identity theft, possible steps should be considered such as blocking the fake website and/or posting a warning on the financial institution’s own website (if it has one), filing a criminal complaint, or seeking legal advice. It might be also advisable to send a direct written notice to all customers, warning them that third parties are impersonating the financial institution and advising them to consult with trusted contacts at the financial institution before making any investments or transfers.
FINMA can publish a warning notice at the request of the financial institution (https://www.finma.ch/en/finma-public/warnungen/). However, as this can also lead to negative publicity, such a measure should be carefully considered.
